IN THE MAGISTRATE COURT OF _______________ COUNTY STATE OF GEORGIA ____________________________, ) Plaintiff, ) CIVIL ACTION FILE v. ) NO. ______________________ ____________________________, ) Defendant. ) CONSENT ORDER WHEREAS, Plaintiff (“Landlord”) has asserted a claim against Defendant (“Tenant”) for unpaid and past due rent for the months of _, in the total principal amount of $_; and WHEREAS, the parties acknowledge and agree the total due as of _, is $_ (the “Balance Due”), which amount Tenant acknowledges and agrees it owes Landlord as of that date; and WHEREAS, the Parties have agreed to a payment schedule to retire the Balance Due, as provided herein; NOW THEREFORE, the Parties have agreed, and the Court hereby ORDERS, as follows: 1. Tenant will pay $_.00 per month, with the first payment due on _, and successive payments due no later than the first day of each subsequent month until the Balance Due is paid in full. Assuming Tenant timely makes the payments required in this Paragraph, Landlord will stay any further efforts to collect the Balance Due. Upon timely receipt of each and every payment required by this Paragraph, Landlord will waive any additional claims for interest, attorney’s fees, or other sums claimed due that arise from the debt resulting in the Balance Due. 2. In the event of a missed payment, Tenant shall be considered in default of this Consent Order, in which event Landlord shall be entitled, at its sole option, to obtain a Writ of Possession, Money Judgment, and issuance of a Writ of Fieri Facias (“Judgment”) against Tenant for the principal balance outstanding, less all payments received. Landlord shall obtain its Judgment in the above-styled civil action by submitting to the Clerk of this Court its (or its attorney's) affidavit certifying the past-due outstanding balance. 3. Tenant hereby waives and/or dismisses any and all claims which it has asserted or may assert against Landlord with prejudice. When the Balance Due and any additional interest or attorney’s fees are paid in full, Landlord shall dismiss its remaining claims against Tenant with prejudice. 4. Time is of the essence of this Consent Order.
